1. Acceptance of Terms
By downloading, installing, accessing, or using the YallAmigo mobile application (the “App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.
The App is operated by Abd El Wahab Hamza, a self-employed individual (trabajador autónomo) based in Spain (see our Legal Notice). These Terms are governed by and construed in accordance with the laws of Spain, including Ley 34/2002 de Servicios de la Sociedad de la Información y de Comercio Electrónico (LSSI-CE), and where applicable, the laws of the European Union including Regulation (EU) 2016/679 (GDPR).
2. Description of Service
YallAmigo is an AI-powered messaging application that provides:
- Real-time text messaging between users
- Automatic AI-powered translation of messages between languages

- File and image sharing within conversations
- Guest access via invite links for unregistered users
- Group conversations with multiple participants

3. Account Registration
- You must provide a valid email address, username, and password to create an account.
- You must be at least 18 years of age to create an account or use the App, including as a guest.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activities that occur under your account.
- You agree to provide accurate and complete information and to update it as necessary.
- We reserve the right to suspend or terminate accounts that violate these Terms.
4. Guest Access
YallAmigo allows unregistered users to join conversations as guests via invite links. As a guest:
- You may join conversations without creating an account by providing a display name and preferred language.
- Guest sessions are temporary and subject to approval by the conversation host.
- Approved guest sessions expire after 24 hours. The host may end or revoke your session at any time.
- All content policies and acceptable use rules apply equally to guests.
- Messages you send as a guest remain in the conversation after your session ends.
5. Acceptable Use
You agree not to use the App to:
- Send, upload, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
- Engage in hate speech, discrimination, or incitement to violence against any individual or group.
- Share sexually explicit content or content involving minors.
- Impersonate any person or entity, or falsely claim an affiliation with any person or entity.
- Send spam, unsolicited messages, or commercial advertising.
- Attempt to gain unauthorized access to other users’ accounts or the App’s systems.
- Interfere with or disrupt the App’s infrastructure, servers, or networks.
- Use automated means (bots, scrapers, etc.) to access the App without prior written consent.
- Circumvent, disable, or otherwise interfere with security features of the App.
- Violate any applicable local, national, or international law or regulation.
6. Content Moderation and Enforcement
We employ automated content moderation systems to help maintain a safe environment. We reserve the right to:
- Remove or block content that violates these Terms or our content policies.
- Temporarily freeze or permanently suspend accounts that violate our policies.
- Terminate guest sessions of users who violate content policies.
- Report illegal content or activities to relevant law enforcement authorities.
If your account is subject to moderation action, you will be notified with the reason. You may appeal moderation decisions by contacting us at admin@yallamigo.com.
7. Intellectual Property
7.1 Our Intellectual Property
The App and its original content (excluding user-generated content), features, functionality, design, and source code are owned by us and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.
7.2 Your Content
You retain ownership of the content you create and share through the App (messages, images, audio, files). By using the App, you grant us a limited, non-exclusive license to process, store, transmit, and display your content solely for the purpose of providing the App’s services, including translation and transcription.
This license terminates when you delete your content or account, except where we are required to retain it for legal compliance.
8. AI Translation and Transcription
- The App uses third-party AI services to provide message translation and, for the subscriptions that still include it, voice transcription.
- AI translations are provided on an “as is” basis. While we strive for accuracy, automated translations may contain errors and should not be relied upon for critical communications.
- We are not responsible for any misunderstandings, misinterpretations, or consequences arising from inaccurate translations.
- Message content is sent to third-party AI providers for processing. Please refer to our Privacy Policy for details on how your data is handled.
9. Subscriptions and Payments
9.1 Free and Paid Plans
The App offers a free plan and optional paid subscription plans (Basic and Premium). Every plan includes a daily allowance of translated messages, shown in the App and on the plans page before you buy. The free plan includes 3 guest invite links in total; paid plans include more.
- Free: 20 translated messages a day.
- Basic: up to 200 translated messages a day.
- Premium: up to 400 translated messages a day, in one pool you can share with the people you talk to. With Premium (and with Yalla Business) you can choose, in each chat, to sponsor the other person’s translations. When you sponsor a chat, the other person’s translated messages come out of your 400 (with Yalla Business, out of your 800) until you stop sponsoring, which you can do at any time. Until then they use their own allowance.
- Yalla Business: up to 800 translated messages a day for your chats and your website visitors together. One sentence is one message; long messages count as more; visitors who write in your language cost nothing (section 10.3).
- What counts as a message: one sentence is one message. A long message counts as more, in proportion to its length, and a message translated into several languages counts once for each language. Only real translations count: messages in the other person’s own language are not translated and not counted, and neither are emoji or photos without text.
- Daily allowances reset at midnight Central European Time (CET/CEST) and do not carry over.
- When the day’s allowance is used up, the message packs you have bought are used (section 9.5). Without them, messages are still delivered but are not translated until the next reset.
If you bought a Basic or Premium subscription before these plans were introduced (an “original plan”), you keep its terms for as long as that subscription keeps renewing: unlimited message translation (fair use) and its daily voice-message minutes. The App shows which plan you are on.
9.2 Billing and Merchant of Record
- Paid subscriptions are billed through Apple App Store or Google Play Store, depending on your device. Apple and Google act as the merchant of record for all in-app purchases, meaning they are responsible for processing payments, collecting applicable taxes, and issuing receipts.
- We do not process, store, or have access to your payment card details or banking information at any time.
- Subscription prices are displayed in the App before purchase and include any applicable taxes as determined by Apple or Google.
- Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
- We may offer free trials or introductory prices from time to time. The store shows the trial length and the price that follows before you confirm; cancel before the trial ends and nothing is charged.
- Subscriptions and message packs are sold only in the App, through Google Play and, on iPhone, the Apple App Store. They cannot be bought on our website, and we do not take card payments ourselves.
9.3 Cancellation and Refunds
- You may cancel your subscription at any time through your Apple App Store or Google Play Store account settings.
- Cancellation takes effect at the end of the current billing period. You will continue to have access to paid features until then.
- Refunds are handled exclusively by Apple or Google in accordance with their respective refund policies. We do not process refunds directly. To request a refund, contact Apple or Google support through your device’s app store.
9.4 EU Right of Withdrawal
If you are a consumer in the European Union, you have the right to withdraw from a digital content purchase within 14 days of the transaction, provided that the digital content has not yet been fully delivered or performed. By initiating a subscription and consenting to immediate access, you acknowledge that you waive this right of withdrawal once the service has been provided.
9.5 Message Packs
- Message packs add translated messages to your account. They are available on every plan, including the free plan, and are bought in the App as one-time purchases, not subscriptions; sections 9.2 and 9.3 apply to them.
- Messages from a pack are used only after the day’s allowance is spent, and they are counted in the same way (section 9.1).
- Message packs never expire. Unused messages stay in your account, also when you change plan or your subscription ends; they are deleted only if you delete your account.
- If you are a consumer in the European Union, the messages of a pack are delivered as soon as you buy it. By buying a pack and consenting to immediate delivery, you acknowledge that you lose the right of withdrawal described in section 9.4 once the messages are credited to your account.
10. Yalla Business: the Chat Box on Your Website
This section applies to Yalla Business, our service for businesses. In it, “you” are the person or company that subscribes to Yalla Business for a business; “your chat box” is the chat window that Yalla Business lets you add to your own website; and “visitors” are the people who write to your business through it. The rest of these Terms continue to apply.
10.1 What Yalla Business Is
- Yalla Business lets a business add a chat box to its own website by pasting a short line of code that the App gives it. Visitors write in their own language, without an account. Their messages arrive in your inbox in the App, where you see which language each visitor writes in. Nothing in a chat is translated, and none of your allowance is used, until you choose to translate that visitor’s conversation; from then on, their messages are translated into your language and your replies into theirs, until you stop translating. You can stop translating, close a visitor’s chat or block a visitor at any time, and switch your chat box off at any time.
- Your chat box works only on the websites you list in the App, and only after we have checked that its code is on that website’s home page. List only websites that you run or are allowed to change. You can get a new code in the App at any time; the old code then stops working.
- Every chat box shows a “Powered by YallAmigo” line and a notice that messages are translated by AI, with a link to our Privacy Policy. You may not remove, hide or cover them.
- Messages and replies are translated automatically and can contain translation errors (section 8).
- The chat box is not an emergency service. If someone may be in danger, they must contact the emergency services.
10.2 Who Is the Trader and Who Is the Customer
- Yalla Business is offered to businesses only. By subscribing, you confirm that you act for the purposes of your trade, business, craft or profession, as a trader. The protections in these Terms that exist only for consumers, such as section 9.4, do not apply to your Yalla Business subscription, except where the law gives them to you anyway.
- Your visitors are your customers, not ours. The conversation a visitor has through your chat box is between the visitor and your business, and any sale or service that follows is a contract between them and you. You are responsible for what you and anyone using your account write to them, for your offers, prices and claims, and for the legal obligations of your business and your website, including telling your visitors about the chat box in your website’s privacy notice.
- YallAmigo provides the chat box and delivers and translates the messages. We are not a party to your dealings with your visitors, and we do not check, endorse or guarantee the businesses that use Yalla Business.
- The conversations on your website are yours: you own your relationship and your interactions with your visitors, and you are responsible for them. You must show your visitors a privacy notice on your website that tells them about the chat box and how their messages are handled.
10.3 The Plan
- Yalla Business is a paid service only. It is not part of the free plan, Basic or Premium.
- It is sold only as a monthly subscription in the App, billed by Google Play or, on iPhone, the Apple App Store; sections 9.2 and 9.3 apply to it. There is no yearly price, no free trial and no discount or introductory price: one plain monthly price, which the store shows before you buy, in your currency and with the taxes of your country. At the date of these Terms, that price is EUR 9.99 a month.
- This section applies from the moment you buy a Yalla Business subscription.
- Translation is included up to 800 translated messages a day for your chats and your website visitors together, and on your chat box only in the conversations you have chosen to translate (section 10.1). One sentence is one message; long messages count as more; visitors who write in your language cost nothing. When the day’s messages are used up, the message packs you have bought are used (section 9.5); without them, messages are still delivered, untranslated, until the next day, and the App tells you so.
- When your subscription ends, your chat box stops accepting new chats and messages. It works again by itself once the store confirms that your subscription is active again, so you can leave the code on your website.
10.4 What Your Chat Box May Not Be Used For
Sections 5 and 6 apply to your chat box, the texts you set for it and every reply sent from your account. In addition, you may not use your chat box to ask visitors for passwords or payment card details, to send them marketing they have not agreed to, or to make visitors believe they are writing to someone other than your business. We may refuse or moderate abusive content sent through your chat box, and we may block a visitor who abuses it (section 10.5).
10.5 Illegal Content, Reports and Our Decisions (Digital Services Act)
For the messages and texts your chat box carries, YallAmigo is a provider of an intermediary service under Regulation (EU) 2022/2065, the Digital Services Act (“DSA”). In line with it:
- Point of contact. Our single point of contact for the authorities of the EU Member States, the European Commission and the European Board for Digital Services, and for the users of our service, including visitors, is admin@yallamigo.com. You can write to us in English or Spanish.
- Reporting illegal content. Anyone, including a visitor, can report content in a chat box that they consider illegal by writing to admin@yallamigo.com. A report should explain why the content is illegal, say where it is (the website and, where possible, the date and time of the message), give the reporter’s name and email address (not required for reports of child sexual abuse material) and state that the report is made in good faith. We confirm that we received it, decide on it in a timely, diligent and objective manner, and tell the reporter what we decided and how they can challenge the decision.
- How we moderate. Automated tools may flag content (section 6); a person reviews every report and every decision to restrict a business. We act with due regard to the rights and legitimate interests of everyone involved, including freedom of expression. Depending on how serious the problem is and whether it is repeated, we may remove or block content, end a visitor’s chat, switch off a chat box, or suspend or end a Yalla Business subscription or an account. Serious cases may be reported to the authorities.
- Statement of reasons. When we restrict content you sent, your chat box or your account, we tell you what we did and how far it goes, the facts and circumstances we relied on, whether automated means were used, the law or the rule in these Terms we relied on, and how you can challenge the decision: by replying to us at admin@yallamigo.com, which leads to a new review by a person, through a certified out-of-court dispute settlement body, or before the courts. We send it by email to the address of your account. We may leave out or delay a statement only where the law allows it.
10.6 Your Visitors’ Personal Data (GDPR Article 28)
For the chats visitors have with your business through your chat box, you are the controller of their personal data and YallAmigo processes it on your behalf, as your processor. This section 10.6 is the contract between you and us that Article 28 of Regulation (EU) 2016/679 (the GDPR) requires:
- Subject matter and duration: running your chat box, for as long as you use Yalla Business and until the data is deleted as described below.
- Nature and purpose: receiving, storing, delivering, showing and automatically translating your visitors’ messages and your replies, and checking that the person who starts a chat is a human and not a program.
- Types of personal data: the messages and their translations, including anything a visitor chooses to write in them; the chat session and its dates (a random session key, of which we store only a scrambled one-way value, a “hash”); the website address where the chat was started (its host name, such as shop.example.com); the language and the type of the visitor’s browser.
- Data subjects: the visitors who write to you through your chat box, and the people they or you mention in the chat.
- Your instructions: we process this data only on your documented instructions, which are these Terms and your settings and actions in the App, unless the law requires us to do otherwise; we tell you if we believe an instruction breaks the law.
- Confidentiality and security: only people bound to confidentiality work with the data, and we protect it with the measures described in our Privacy Policy (section 5).
- Sub-processors: you authorise us to use the sub-processors named in section 10 of our Privacy Policy (our AI translation and moderation providers and our hosting provider). Each processes the data under the data processing terms it offers. Before we add or replace one, we update that list and tell you by email at least 30 days in advance; if you object, you can end your subscription before the change takes effect.
- Transfers outside the European Economic Area: some sub-processors are established outside it (section 12 of our Privacy Policy), and we rely on the safeguards the GDPR provides for such transfers, such as standard contractual clauses where applicable.
- Help with your obligations: we help you, as far as the nature of the processing allows, to answer visitors who exercise their rights and to meet your obligations on security, breach notification and data protection impact assessments. We tell you without undue delay after we become aware of a personal data breach that affects your visitors’ data. If a visitor writes to us about a chat with you, we pass the request on to you.
- Deletion: you can delete a visitor’s conversation in the App at any time, and we then delete it from our systems. When your subscription ends, the conversations stay in your inbox until you delete them or your account; when you delete your account, they are deleted with it. We keep data longer only where the law requires us to.
- Audits: we make available to you the information necessary to show that we meet these obligations, and allow audits by you or an auditor you appoint, on reasonable notice, by writing to admin@yallamigo.com.
YallAmigo is an independent controller, not your processor, for what we do for our own purposes: keeping the service secure, preventing abuse, moderating content under these Terms and meeting our legal obligations. When you choose to add a visitor as a friend, your chat box shows the visitor a line inviting them to get the App and add your business as a friend; no link to a guest chat is sent. When a visitor then chats with you in the App with a YallAmigo account, that chat is part of our messaging service, and we process it as controller under our Privacy Policy.
11. Limitation of Liability
To the maximum extent permitted by applicable law:
- The App is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, either express or implied.
- We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
- We do not warrant the accuracy, reliability, or completeness of any AI-generated translations or transcriptions.
- In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
- Our total liability to you for any claims arising from or related to the App shall not exceed the amount you paid for the App in the 12 months preceding the claim, or 100 euros, whichever is greater.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded or limited under applicable law, including mandatory consumer protection rights under EU law.
12. Indemnification
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless YallAmigo and its operator from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any applicable law or the rights of any third party
- Content you submit, post, or transmit through the App
If you are a consumer, this section applies only to claims caused by your breach of these Terms or of the law, and it never limits the rights the law gives you.
13. Termination
- You may terminate your account at any time by using the “Delete My Data” feature in the App or by contacting us.
- We may suspend or terminate your account at any time for violation of these Terms, with or without prior notice.
- Upon termination, your right to use the App ceases immediately.
- Account deletion permanently removes your personal data, messages, and files from our systems.
- Sections of these Terms that by their nature should survive termination (including Intellectual Property, Limitation of Liability, Indemnification, and Governing Law) shall survive.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of Spain, without regard to its conflict of law provisions. For consumers within the European Union, mandatory consumer protection laws of your country of residence shall apply to the extent they provide greater protection.
Any disputes arising from these Terms or the use of the App shall be submitted to the competent courts of Spain. EU consumers may also bring proceedings in the courts of their country of residence.
We are not adhered to any alternative dispute resolution entity. If you are a consumer and a complaint cannot be settled between us, you may turn to the consumer arbitration system of Spain (Sistema Arbitral de Consumo) or to the consumer authority of your country of residence.
15. Changes to the Service and to These Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms within the App or on our website with an updated “Last updated” date. For material changes that affect your rights, we will provide at least 30 days’ notice before the changes take effect.
We may change, add or remove services and features of the App in the future, for example to improve the App, for security or legal reasons, or because a feature is no longer offered. Where the law requires it, we will tell you in advance and within a reasonable time. If a change affects a paid service to your disadvantage in more than a minor way, you may end your subscription, and you keep every right the law gives you. Message packs you have bought never expire (section 9.5).
Your continued use of the App after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the new Terms, you must stop using the App.
16. Miscellaneous
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.
- Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
- No Waiver: Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision.
- Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
- Language: These Terms are drafted in English. In case of any discrepancy between translated versions and the English version, the English version shall prevail.
